Q: Can I obtain legal custody of the child I’m raising?
A: Yes. If it’s determined to be in the best interest of the child, custody can be awarded to you. However, every situation is unique, and sound legal representation is important.

Q: What are the benefits of having legal custody?
A: With legal custody, you will have legal authority to make decisions touching every part of your grandchild’s life. Such decisions are encountered every day, from signing a school permission form to registering for camp to getting medical treatment for the child. Another benefit is that the birth parents may be ordered to provide child support and health insurance.

Q: Is financial assistance available for the child I’m raising?
A: Yes. Benefits from the Minnesota Family Investment Program (MFIP) are available. If you are a relative, you don’t need legal custody or legal representation to apply for MFIP Child Only Grant. If you're not related, MFIP may be available once a court order is issued. In either case, your income isn’t a factor when determining the amount of assistance the child receives. All you need to do is contact the human services office in your county.

Q: Can my grandchild receive health benefits?
A: Whether you have legal custody or not, health and dental insurance coverage is available through your county and part of the process when you apply for MFIP. Your child doesn't have to receive MFIP in order to get insurance coverage. For help, visit your county human services office.

Q: Will my grandchild’s birth parents have to reimburse the government for the MFIP assistance my grandchild receives?
A: Yes, the government can turn to the parents for reimbursement.

Q. Does the information on this website apply just to grandparents?
A: No. It applies to aunts, uncles, and others raising someone else’s child. But, every circumstance is unique, and sound legal representation is important.

P: ¿Es posible obtener custodia legal del niño que estoy creando?

R: Sí.   Ud. puede recibir custodia legal del niño al determiner si la custodia suya está en el mejor interés del niño.   Sin embargo, cada situación es distinta y se recomienda obtener buena representación legal.

P: ¿Cuáles son los beneficios de tener custodia legal?  

R: Con custodia legal, Ud. tendrá la autoridad legal de hacer decisiones que afectan todos los aspectos de la vida del niño.   Se encuentran tales decisiones todos los días, tal como firmar un permiso de la escuela hasta inscribirle en un encampamiento u obtener tratamiento médico para el niño.   Otro beneficio es que se puede esforzar a los padres del niño pagar su mantener y el seguro médico.

P: ¿Es posible obtener asistencia financiera para el niño que estoy creando? 

R: Sí.   Se puede obtener beneficios del MFIP (Minnesota Family Investment Program).   Si Ud. es pariente del niño, Ud. no necesita custodia legal ni representación legal para aplicar para el MFIP.   Si Ud. no es pariente, MFIP es disponible una vez que la corte salga con su orden legal.   En cualquier caso, sus ingresos no son factores para determinar la cantidad de asistencia financiera que recibe el niño. Lo que Ud. necesita hacer es ponerse en contacto con el departamento de servicios humanos en su condad.

P: ¿Puede recibir beneficios médicos mi nieto?
